By creating an account or using the Featurely service (the "Service"), you agree to these Terms and Conditions ("Terms"). These Terms constitute a binding legal agreement between you (the user) and Featurely, governing your access to and use of our website, app, and platform. If you do not agree with any part of these Terms, you must not use the Service. Your continued use of the Service indicates your acceptance of and compliance with these Terms.
To use the Service, you must create an account with a valid email address and accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to: (a) provide true, current, and complete information during sign-up and promptly update it if it changes; and (b) notify us immediately of any unauthorized use of your account or security breach. We are not liable for any loss or damage arising from your failure to protect your account credentials.
You must be at least 16 years old to use the Service. If you are under the legal age in your jurisdiction, you may only use the Service with verifiable parental consent, as required by applicable data protection laws. Featurely does not knowingly collect data from individuals under 16.
Use of certain features or continued access to the Service may require payment of subscription fees or other charges. When you subscribe or provide billing information, you agree to: (a) pay all applicable fees and taxes in a timely manner, using a valid payment method; and (b) allow us (or our payment processor) to charge your provided payment instrument for the subscription fees and any applicable taxes. All payments are subject to our billing terms in effect at the time of payment. If your payment method fails or your account is past due, we may suspend or terminate your access to the Service. Billing information is collected solely for processing payments and will be handled securely in accordance with our Privacy Policy.
Featurely offers a 14-day full refund window for new subscriptions. For annual plans, refunds for the unused portion of the subscription may be granted within 30 days upon request. Pro-rata refunds will be issued for service interruptions, Featurely-initiated cancellations, or documented SLA breaches. Beyond these, all fees are non-refundable unless required by law.
Our Service allows you to upload or input content – including documents, designs, specifications, or other data – for analysis through our platform ("User Content"). You retain all rights to your User Content. We do not claim ownership of the content you submit to the Service. By uploading User Content, you grant Featurely a non-exclusive, worldwide, royalty-free license to use, store, and process your content for the purpose of providing and improving the Service. This license allows us to perform operations such as processing your documents, generating synthetic user simulations, and delivering results to you. We will not use your content for any purposes outside of operating and enhancing the Service without your consent.
You are solely responsible for the content you upload and must ensure you have the necessary rights and permissions to use and share it. Please do not upload any information that is highly sensitive or confidential unless you are comfortable doing so. While we implement industry-standard security measures to protect your data, no system is 100% secure. You acknowledge that any non-public or proprietary information you submit is provided at your own risk. Featurely will treat your User Content as confidential and will not disclose it to other users or third parties, except: (a) as needed to operate the Service (for example, using trusted cloud service providers bound by confidentiality obligations); (b) as required by law or legal process; or (c) with your explicit permission. However, we disclaim liability for any unintended disclosure or loss of data that is not due to our willful misconduct, and you agree that we are not to be held accountable for consequences of you uploading such content.
Deleted user content is retained for 30 days post-deletion, after which it is permanently removed. Account-related metadata may be retained for up to 90 days after termination. Financial records are retained for 7 years. Users may request data exports in JSON or CSV formats. Standard processing time is within 7 days of request receipt, not to exceed 30 days.
When using our Service, you agree to do so in a lawful and respectful manner. You will not:
We reserve the right to suspend or terminate accounts that engage in prohibited conduct or otherwise misuse the Service. You are responsible for ensuring that all persons whom you allow to use the Service through your account understand and comply with these Terms.
Your privacy is important to us. Our Privacy Policy (available on our website) explains how we collect, use, and protect your personal information and User Content. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. We are committed to protecting your data and employ administrative, physical, and technical safeguards to secure it. In fact, our platform is built with a privacy-first approach, ensuring data security by not using real personal user data in simulations.
The Service uses synthetic data and AI-generated personas for analysis, which means that insights are derived without exposing any real individual's personal information. This approach not only preserves confidentiality but also helps eliminate risks of real-world data exposure while still providing valuable insights.
Featurely adheres to applicable data protection laws and regulations. We comply with the California Consumer Privacy Act (CCPA) and maintain robust security and privacy practices consistent with SOC 2 standards. We are also continually working towards alignment with the EU General Data Protection Regulation (GDPR) and relevant ISO data security standards. You should refrain from uploading personal data or regulated information unless necessary, but if you do, we will handle such personal data in accordance with applicable laws and our Privacy Policy. We do not sell personal information to third parties. If you are an individual in certain jurisdictions, you may have specific privacy rights (for example, rights to access or delete personal data) as detailed in our Privacy Policy.
All rights, title, and interest in and to the Service, including our software, algorithms, artificial intelligence models, features, website content, and trademarks or brand elements, are owned by Featurely or its licensors. These Terms do not grant you any ownership rights in the Service or the underlying intellectual property. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your internal business purposes in accordance with these Terms. You may not use our name, logos, or other trademarks without our prior written consent.
You retain ownership of all intellectual property rights in the User Content you submit. Aside from the license you grant us to operate the Service, as described in User Content and Confidentiality above, Featurely does not obtain any proprietary rights in your content. The outputs, analyses, reports, and results generated by the Service for you (collectively, "Results") are provided to you for your use. To the extent the Results incorporate or are derived from your User Content, you retain ownership of those elements of the Results. We grant you a license to use any Featurely-generated portions of the Results for your internal purposes. Note that our underlying algorithms and methods used to produce Results remain our intellectual property.
If the Service includes any references to or integration of third-party data, libraries, or services, all trademarks, logos, or content of third parties remain the property of their respective owners. Any references to third-party names or content (for example, in a synthetic user simulation scenario) are for illustrative or analytical purposes only and do not imply any affiliation with or endorsement by those third parties. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on the Service or any reports or content generated by the Service.
Featurely commits to 99.9% Service availability uptime per calendar month, excluding scheduled maintenance and emergency downtime. Scheduled maintenance will occur outside normal business hours and with at least 48 hours' advance notice. Users affected by downtime may be eligible for service credits: 10% of monthly fees for uptime below 99.9%, and 25% for uptime below 99%. Critical support requests will be acknowledged within 1 hour and addressed based on severity levels. This SLA does not apply to beta features or free accounts.
While Featurely strives to maintain a high level of service availability, we do not guarantee uninterrupted access to the Service. Any commitments to service uptime or performance are governed by a separate Service Level Agreement (SLA) if executed between you and Featurely.
Use of Featurely APIs (when available) is subject to rate limits defined by subscription tier. Default limits are 100 requests/day (free), 1000/day (paid), with custom SLAs for enterprise. API keys must remain confidential. Featurely reserves the right to modify or deprecate endpoints with 30 days' notice. Violations may result in key revocation or access suspension.
The Service may include links to or integrations with third-party applications, tools, or services ("Third-Party Services"). Featurely is not responsible for the availability, content, or functionality of any Third-Party Services and disclaims all liability arising from your use of them. Use of such services is governed solely by the terms of those third parties.
From time to time, Featurely may offer early access to experimental or beta features. These features are provided "as is" and may be modified, suspended, or discontinued at any time without prior notice. Use of beta features is at your sole discretion and risk. Featurely does not guarantee the performance, availability, or support of beta features and disclaims all liability arising from their use.
If you provide any feedback, ideas, suggestions, or recommendations to Featurely regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, disclose, sublicense, and exploit that Feedback for any purpose without restriction or compensation to you.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind. Featurely makes no guarantee that the Service will meet your requirements, be error-free, uninterrupted, or that the results obtained from the Service will be completely accurate or reliable. Our platform uses artificial intelligence to simulate user behaviors and opinions; these are simulations and not actual human feedback. As such, the insights and results are for informational and research purposes only and are not intended as a definitive prediction or guarantee of real-world performance. We expressly disclaim any warranties or representations that the synthetic user personas or their responses will reflect actual consumer behavior with 100% accuracy.
You acknowledge that any decisions or actions you take based on the Service's outputs are taken at your own risk. Featurely does not warrant the correctness, completeness, merchantability, or fitness for a particular purpose of any information or Results provided. No advice or information, whether oral or written, obtained from Featurely or through the Service, shall create any warranty not expressly stated in these Terms. We further clarify that any synthetic personas, user insights, or fictional scenarios generated by the Service are not real individuals. Any resemblance of synthetic users to actual persons (living or deceased) or actual entities is purely coincidental and unintended. Additionally, if the Service provides analyses involving third-party brands, products, or scenarios, those analyses do not reflect the opinions of any real individuals or those third parties. You should not interpret any output as an endorsement or criticism by real persons.
Featurely is an innovative tool meant to assist and augment your product research and decision-making; however, it is not a substitute for professional judgment or live user research when such is required. Always use your discretion and consider validating critical findings with real-world testing.
To the maximum extent permitted by law, in no event will Featurely or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) the Service or reliance on its outputs. This includes, without limitation, any loss of profits, loss of data, business interruption, computer damage, or system failure, or the cost of substitute services, even if we have been advised of the possibility of such damages.
Featurely's total cumulative liability to you for any claims arising from or related to the Service or these Terms shall not exceed the amount you have paid to Featurely in the last twelve (12) months (if any) for the Service, or one hundred U.S. dollars (USD $100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you to the extent disallowed by applicable law. In such cases, our liability will be limited to the fullest extent permitted by applicable law.
You acknowledge that Featurely has offered the Service and set its prices in reliance upon the disclaimers of warranty and the limitations of liability set forth herein, which reflect an agreed allocation of risk between you and us. You agree that the limitations and exclusions of liability are fair and reasonable, and that they form an essential basis of the bargain between you and Featurely.
You agree to defend, indemnify, and hold harmless Featurely, its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your violation of these Terms or misuse of the Service; (b) your violation of any applicable law or regulation in connection with your use of the Service; (c) any content you upload or provide (including claims that your User Content infringes or misappropriates the intellectual property, privacy, or other rights of any third party); or (d) your gross negligence or willful misconduct. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You will not settle any such claim without our prior written consent.
You may not use, export, or re-export the Service or any part of it except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained. You represent that you are not located in, and will not use the Service in, any country subject to U.S. trade sanctions (e.g., Cuba, Iran, North Korea, Syria) or on any U.S. government denied-party list.
Featurely shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, terrorism, civil unrest, labor disruptions, power outages, failures of telecommunication or internet service providers, cyberattacks, internet outages, third-party cloud provider disruptions, or government actions. We will notify users within 10 days of such an event, make reasonable efforts to restore Service, and suspend SLA enforcement during the disruption.
We may modify or update these Terms from time to time to reflect changes in our practices, Service offerings, or legal requirements. For material changes to these Terms (including those affecting billing, liability, or user rights), Featurely will provide at least 30 days' notice via email, in-app alert, and website notice. Your continued use after such changes constitutes acceptance. Non-material updates may be made without prior notice. It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes to the Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you should stop using the Service and, if applicable, cancel your account.
Either you or Featurely may terminate this agreement at any time. You may cease using the Service and close your account at any time if you wish to terminate. Featurely may suspend or terminate your access to the Service (or any part thereof) immediately, without prior notice or liability, if you breach any provision of these Terms or if we are required to do so to comply with law or if continuation of Service is no longer commercially viable for us. We may also terminate your account for inactivity or if we discontinue the Service.
Upon any termination of these Terms or your account, the rights and licenses granted to you will cease immediately. You will no longer have access to your account, and we may delete your User Content associated with the account (except to the extent we are obliged or permitted to retain it under applicable law or our data retention policies). Sections of these Terms that by their nature should survive termination (such as disclaimers of warranty, limitations of liability, indemnification, and governing law) will survive. Termination of your access or account will not relieve you of any obligations or liability accrued prior to the termination date (including payment obligations).
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. If you reside outside of the United States, you understand and agree that you are voluntarily using the Service, and that U.S. laws (including privacy and data protection laws) may differ from the laws of your jurisdiction. You agree that any disputes or claims arising out of these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco, California, and you consent to personal jurisdiction and venue in such courts. Notwithstanding the foregoing, Featurely may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent any actual or threatened misuse or infringement of its intellectual property or other proprietary rights.
If you are a consumer residing in a jurisdiction with laws that give you the right to bring or defend claims in your local courts despite a contractual choice of forum, nothing in this Governing Law section affects any rights you may have under such laws. Similarly, if applicable law imposes that another body of law is required to apply to certain types of issues (such as consumer protection laws in your country of residence), that law will apply to those extent required.
